Dear Mr. Leyse:
Thank you for contacting the Office of Government Information Services (OGIS). Congress created OGIS to serve as the Federal Freedom of Information Act (FOIA) Ombudsman. We assist the public and Federal agencies by helping them resolve their FOIA disputes, and by addressing their questions and concerns about the FOIA process. Our jurisdiction is limited to assisting with the FOIA process. An OGIS facilitator will review your submission. If we must contact the agency for the status of your request or appeal, we will do so immediately and contact you again once we receive that information. We look forward to assisting you.

Thank you for contacting the Office of Government Information Services (OGIS), the Federal Freedom of Information Act (FOIA) Ombudsman office. This responds to your submission which we received on September 21, 2019. We carefully reviewed your submission and have determined that: You sent OGIS a FOIA request in error. OGIS does not review or process FOIA requests. The FOIA request needs to be sent directly to the agency from which you seek records. X You sent OGIS correspondence intended for the agency to which you submitted your FOIA request. OGIS is an independent office not associated with that agency. You are appealing the agency’s initial response. Please send your appeal to the appropriate agency FOIA appeal official by following the directions provided in the agency’s response letter. You sent OGIS non-FOIA related correspondence. OGIS only addresses issues related to FOIA disputes between requester’s and agencies. As a result, please redirect your submission to the appropriate agency or entity.

Recent expansion of pending FOIA

Subject: FOIA Request NRC-2020-000007
Date: 10/13/2019 9:07:17 PM Mountain Standard Time
From: bobleyse@aol.com
To: Tina.Ennis@nrc.gov

Dear Tina Ellis:

Thank you for your questions which has clarified my request for NRC’s AEOD documents that relate to communications between AEOD and NSAC.  You have motivated me to examine my FOIA in greater detail.

In response to your requests for clarification it is clear that I want every correspondence between NSAC and AEOD.  Now, in addition to that, I want all the AEOD documentation that relates to NSAC even though that is not in the category of every correspondence between NSAC and AEOD.  I believe that there may be such documents that did not lead to correspondence between NSAC and AEOD.

In paragraph 3 there is reference to a Region III inquiry.  I want a copy of that Region III inquiry.

Dear Tina,
I have no list of those docs.  I believe those contacts must have been logged. If not, that is it, but I believe that records must have been maintained.  Thank you.

Dear Mr. Leyse:
We received your Freedom of Information Act (FOIA) request on October 7, 2019.
Your request, which seeks access to, in relation to a December 13, 1984 memorandum, regarding a telephone conversation with Wayne Lanning on December 12, 1984, a copy of the Office for Anaylsis and Evaluation of Operational Data (AEOD) memorandum dated February 28, 1984, the AEOD evaluation, the memorandum dated October 3, 1984, "UHI-Ultra High Risk" with the obscured features, the joint AEOD/NRR response to Keppler, and all the records pertaining to the technical relationship between the Nuclear Safety Analysis Center (NSAC) and AEOD, has been assigned the following reference number that you should use in any future communications with us about your request: NRC-2020-000007.
To ensure the most equitable treatment possible of all requesters, the NRC processes requests on a first-in, first-out basis, using a multiple track system based upon the estimated time it will take to process a request. Based on your description of the records you are seeking, we estimate completion of your request will be on or before November 20, 2019. Please note that we are estimating that completion will take more than 20 working days because, due to the age of the records, if available, we expect we may have to:
☐ search for, collect, and appropriately examine a voluminous amount of records
☐ consult with multiple program and/or regional offices within the NRC
☐ consult with other Federal agencies having equities in the records
☐ refer records to a licensee, or other business submitter
☐ undertake a declassification review of classified records; or
☒ retrieve records from Federal Records Centers or other off-site facilities.
Please know that this date is a rough estimate of how long it will take us to close requests ahead of yours in the respective track and complete work on your request. The actual date of completion might be before or after this estimate, based on the complexity of all the requests in the complex track. We will advise you of any change in the estimated time to complete your request. In an effort to process your request promptly, you may wish to narrow the scope of your request to limit the number of responsive records.
For purposes of assessing fees in accordance with our regulations (10 CFR 9.33), we have placed your request in the following category: Non-Excepted. If applicable, you will be charged appropriate fees for: search. Unless you state otherwise, we expect to provide our response, including any released records, electronically; therefore, you will not incur duplication charges.
A sheet has been enclosed that explains in detail the fee charges that may be applicable. Please do not submit any payment unless we notify you to do so.
The following person is the Government Information Specialist who has been assigned responsibility for your request: Tina Ennis, who may be reached by telephone at 301-415-5616 or via email to Tina.Ennis@nrc.gov.
If you have questions on any matters concerning your FOIA request, please feel free to contact the assigned Government Information Specialist or me at (301) 415-7169.
Sincerely,
Stephanie A. Blaney /s/
